In 2010,1 Pradaxa® was first approved for patient use by the United States Food and Drug Administration (FDA). This blood-thinning drug was boasted as a better option for patients, and Pradaxa fast became a commonly prescribed medication. However, in the nearly three years since Pradaxa has been on the market, the FDA has received a record number of complaints2 and hundreds of lawsuits have been filed, resulting in the establishment of a multi-district litigation (MDL) case.
What is an MDL?
When different plaintiffs file cases in different courts but seem to have similar claims, the risk for inconsistencies is great.3 So under federal law, civil cases, which are cases seeking money damages, can be handled as a group through MDL.
An MDL is a consolidation of class action lawsuits.4 The types of cases generally handled under MDLs include personal injury, product liability and similar mass tort litigation cases.
Pradaxa litigation, MDL 2385 products liability litigation
MDLs have been created for several types of large lawsuits, including Pradaxa.5 Since the formation of the MDL system, there have been thousands of these types of cases handled by the federal courts for everything from harmful prescription drugs to shady business dealings.6 Last year, the Pradaxa lawsuits were merged into MDL No. 2385 and given the product liability classification.
Since 2012, Judge David R. Herndon has presided over the Pradaxa class action matters, which are heard in the United States District Court, Southern District of Illinois. Over 100 personal injury/product liability cases are part of the MDL. Thus far, the personal injury and product liability litigation attorneys have argued for obtaining company documents, medical authorizations for plaintiffs, and which state’s laws will apply to certain issues.
Pradaxa problems and side effects
Since 2010, the FDA has been receiving complaints about problems with Pradaxa. Patients having problems with Praxada have complained to their doctors about a wide range of symptoms. These troubling symptoms include:7
- Vomiting or coughing blood
- Brown or pink urine
- Bleeding gums
- Bruises that increase in size
- Frequent nose bleeds
- Red or black stools
Looking beyond the symptoms, serious side effects from using Praxada include:8
- Heart attacks
- Intracranial bleeding
- Gastrointestinal bleeding (stomach and intestines)
- Blood clots (in vessels/heart valves)
Drug companies have a legal duty to make and sell safe products. Boehringer Ingelheim Pharmaceuticals, Inc., the makers of Pradaxa, has made millions of dollars from prescriptions, and the company is now facing expensive litigation because of a failure to be true to that duty.
